End-User License Agreement ("EULA") 2. Privacy Policy ====================================================================== PART 1: END-USER LICENSE AGREEMENT ("EULA") ====================================================================== 1. Acceptance of Terms By downloading, installing, or using MetaDock, you agree to be bound by these terms. If you do not agree, do not use MetaDock. 2. Definitions "Software" refers to MetaDock and all associated components. "User" refers to any individual or entity using MetaDock. "Content" refers to all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials. 3. License Grant Gammal Software, Inc. grants you a non-exclusive, non-transferable license to use MetaDock in accordance with these terms. 3.1 Installation Scope All individual plans (MetaDock, MetaDock Pro) permit one (1) active installation per license. Installing on a new device will automatically invalidate the license on your previous device. You do not need to purchase additional licenses for reinstallation on a different computer. Enterprise and Self-Hosted API licenses are available by separate written agreement and are not covered by this EULA. Contact sales@metadock.app for terms. 3.2 License Sharing Prohibited Your license is personal and non-transferable. You may not share, lend, sell, sublicense, or otherwise transfer your license credentials to any other person or entity. Each user must have their own valid subscription. 3.3 Server Deployment Restriction MetaDock licenses are intended for use on the licensed user's own machine (physical, virtual, or cloud-hosted) and for that user's own purposes, including driving MetaDock programmatically via the local APIs described in §25 (AI-Assisted Automation) and §26 (API Usage). The following are NOT permitted under a standard license: (a) Operating MetaDock as a multi-tenant automation service that performs browsing or automation tasks on behalf of third parties (other end users) without an Enterprise or Self-Hosted license agreement that explicitly authorizes such use. (b) Sharing a single license's API endpoint with other people so they can drive MetaDock from their own machines (each user must hold their own valid subscription per §3.2). (c) Reselling MetaDock's automation capacity as a hosted service. Running MetaDock headlessly on your own server or cloud VM to drive your own AI agent (e.g., Claude Desktop in headless mode on Pro) against your own browsers IS permitted, subject to §25 and §26. Violation of this restriction may result in license termination after the cure period described in §11. 3.4 Internet Requirement MetaDock requires an active internet connection for license activation and periodic validation. The Software may not function if unable to verify your license status. 3.5 Platform MetaDock is currently available for Windows only. Future platform support may be added at Gammal Software's discretion. 3.6 Local Data MetaDock stores all user data (profiles, bookmarks, workspaces, settings) locally on your device. You are responsible for backing up your data. Gammal Software does not have access to your local data. 4. Intellectual Property All rights, title, and interest in and to MetaDock, including all intellectual property rights (patents, copyrights, trademarks, trade secrets), remain the exclusive property of Gammal Software, Inc. This Agreement does not transfer any ownership rights to you. You acquire only the limited license to use the Software as expressly granted herein. 5. Restrictions You may not: 5.1 Modify, reverse engineer, decompile, or disassemble MetaDock. 5.2 Distribute copies of MetaDock to third parties without written permission from Gammal Software, Inc. 5.3 Use MetaDock in a manner that violates any applicable laws or regulations. 5.4 Export or re-export the Software in violation of Canadian export controls under the Export and Import Permits Act (EIPA) and Export Control List (ECL), or applicable local regulations. 6. Third-Party Components MetaDock may include open-source or third-party components. Your use is also subject to any licenses for those components; see the "licenses" folder for details. 6.1 IP Geolocation Data MetaDock includes IP geolocation data provided by DB-IP (https://db-ip.com), licensed under the Creative Commons Attribution 4.0 International License (CC BY 4.0). See licenses/CC-BY-4.0.md for the full attribution and license terms. Required attribution: "IP Geolocation by DB-IP (https://db-ip.com)" IP lookups are performed locally within MetaDock. No IP address information is transmitted to DB-IP or any other external service. 7. Maintenance & Support 7.1 Updates Your subscription includes access to all Software updates released during your active subscription period. Updates may include bug fixes, security patches, new features, and improvements. Gammal Software reserves the right to add, modify, or remove features at any time. 7.2 Support Support is provided via email at support@metadock.app. Response times are on a best-effort basis and are not guaranteed. 8. User Conduct You agree not to use MetaDock to: 8.1 Violate any local, state, national, or international law. 8.2 Infringe the intellectual property rights of others. 8.3 Transmit harmful, offensive, or illegal content. 8.4 Harass, abuse, or harm another person. 8.5 Access, scrape, or automate interactions with websites in violation of their Terms of Service, robots.txt directives, or without proper authorization. 8.6 Circumvent geographic restrictions, access controls, rate limiting, CAPTCHAs, or authentication mechanisms without authorization. 8.7 Operate multiple accounts on platforms that prohibit multi-accounting, or evade account suspensions or bans. 8.8 Engage in ad fraud, click fraud, fake engagement, credential stuffing, or automated manipulation of online platforms. 8.9 Scrape, collect, or process personal data in violation of privacy laws (including but not limited to GDPR, CCPA, PIPEDA). 8.10 Evade bot detection or fingerprinting mechanisms for unauthorized or fraudulent purposes. 8.11 Embed or manipulate third-party applications in violation of their license agreements or terms of use. 9. Fees, Payment & Taxes 9.1 License Fees INDIVIDUAL PLANS (billed in U.S. Dollars): MetaDock - US$19/month (or US$170/year): • Unlimited browser profiles, layouts, and workspaces • No licensed browser-panel limit; practical capacity depends on your hardware • Per-profile isolation across every monitor • Symbol Manager and the Live Info Bar • Opt-in anti-fingerprint profile isolation (see §29) MetaDock Pro - US$49/month (or US$440/year): • Everything in MetaDock, with identical limits • Every automation protocol: REST API, Model Context Protocol (MCP), Chrome DevTools Protocol (CDP), W3C WebDriver (Selenium), and WebSocket • API use is not metered: there is no monthly or daily request quota • Headless mode • The mdk command line • Built-in AI assistant There are two plans. The difference between them is automation: the interfaces described in §26, headless mode, the command line, and the built-in AI assistant are available on MetaDock Pro only. No limit differs between the two plans. 9.1.1 Free Trial MetaDock may be evaluated free of charge for fourteen (14) days. No payment method is required to begin a trial. (a) The trial period begins the first time the Software is activated on a device, not when the trial is requested. An installer that is downloaded but not opened does not consume the trial period. (b) The trial grants MetaDock Pro, the higher of the two plans. It is not a reduced or feature-limited version of the Software. If you subsequently subscribe to MetaDock rather than MetaDock Pro, the features listed as MetaDock Pro only in §9.1 will stop being available when the trial converts. (c) One trial per person and one trial per device. A trial is issued against a verified email address, and is recorded against the device it is activated on. A second trial will not be issued to the same email address or to the same device, whether or not a different email address is used. (d) Email addresses provided by temporary, disposable, or throwaway mail providers are not accepted for trial registration. (e) When the trial period ends, the Software will not start until a subscription is purchased. This is a full stop, not a reduction in features: there is no free tier to fall back to. (f) Your data is not deleted when a trial ends. Profiles, workspaces, layouts, bookmarks, credentials, and settings are stored locally on your device (see §3.6) and are untouched by trial expiry. They remain available if you subscribe later. (g) If you subscribe during or after a trial, your existing license key and device activation continue to work. You are not required to enter a new key or re-activate. (h) Gammal Software may refuse or revoke a trial where it has reasonable grounds to believe the trial system is being circumvented, including through repeated registration using different email addresses or altered device identifiers. 9.1.2 Legacy Free Licenses Licenses issued under the previous free tier, before it was withdrawn, remain valid on their original terms and are not converted to trials. Holders of such licenses are unaffected by §9.1.1. They do not expire and are not billed. Where a legacy license is mapped onto the current plans, it is mapped to MetaDock, not MetaDock Pro. The automation interfaces described in §26, headless mode, the command line and the built-in AI assistant therefore require a MetaDock Pro subscription, on the same terms and at the same price as for any other customer. Paid plans are billed upfront. ENTERPRISE AND SELF-HOSTED PLANS: Enterprise and Self-Hosted API agreements are available on request and are priced on a case-by-case basis under separate contracts. Current pricing is always authoritative at https://metadock.app/pricing. 9.2 Billing & Payment • Billed in advance (monthly or yearly) via Stripe. • Stripe will send a renewal reminder email 7 days before each billing date. • If payment fails, Stripe will retry up to 4 times within 3 weeks. If all retries fail, your subscription will be automatically canceled. 9.3 Auto-Renewal • Subscriptions automatically renew at the end of each billing period until canceled. • You will be charged the then-current rate at each renewal. • You can cancel at any time from the billing portal. Cancellation takes effect at the end of the current billing period and stops all future renewals; no advance-notice window is required. 9.4 Trial and Billing • The 14-day trial requires no credit card, so you can evaluate the Software fully before paying anything. See §9.1.1. • MetaDock is billed upfront on the billing period you select at checkout, and renews automatically each period until you cancel. • You are charged when you subscribe. No payment method is collected during the trial, so the trial cannot convert into a charge on its own: it ends by stopping, not by billing you. 9.5 Cancellation and Refunds • The main way to stop charges on a paid plan is to cancel. You can cancel at any time to stop all future renewals. • Refunds for charges already taken are considered on a case-by-case basis at Gammal Software's sole discretion. • Nothing in this section limits any right you may have under the Ontario Consumer Protection Act, 2002 or other applicable consumer-protection legislation that cannot be waived by agreement. • To cancel or request a refund, use the billing portal link included in your purchase emails (see 9.7) or email support@metadock.app with your order details. 9.6 Upgrades & Downgrades • Plan changes take effect next billing cycle. 9.7 Customer Portal • All members can access their subscription and billing portal at: https://billing.stripe.com/p/login/3cs8x32pH3aX5iM7ss 9.8 Taxes • Displayed prices are exclusive of tax. Any applicable sales tax, VAT, GST, or HST is determined from your billing location and added at checkout, so the total charged may exceed the displayed price. 10. Indemnification You agree to indemnify and hold harmless Gammal Software, Inc. and its affiliates from any claims, damages, liabilities, and expenses arising from your use of MetaDock or violation of this Agreement. Gammal Software, Inc. will defend you against third-party IP infringement claims for the Software. 11. Term and Termination This Agreement is effective until terminated. Gammal Software, Inc. may terminate this Agreement if you breach any term. For curable breaches, Gammal Software will provide at least fourteen (14) days' written notice and a reasonable opportunity to cure before terminating, except where the breach involves fraud, threats to platform integrity, illegal activity, or violation of law, in which case Gammal Software may terminate immediately. Upon termination, you must cease use and destroy all copies of MetaDock in your possession. This 14-day cure period reflects reasonable-notice principles applicable in Ontario, the governing jurisdiction of this Agreement. 12. Survival Sections on Restrictions, User Conduct, Indemnification, Disclaimer, Limitation of Liability, Fees, Confidentiality, Browser Automation & Web Scraping, AI-Assisted Automation, API Usage, Third-Party Platform Compliance, Proxy Usage, Device Emulation, Geolocation & Browser Fingerprint Customization, Privacy & Stealth Modes, Third-Party Applications, Web Browsing & Third-Party Content, Browser Extensions, Financial Data Disclaimer, Ad and Tracker Blocking, Downloads & Captured Files, and Health & Safety Warnings survive termination. 13. Confidentiality Both parties agree to protect each other's confidential information and not to disclose it to third parties. 14. Disclaimer of Warranties MetaDock is provided "as-is" without warranty. Gammal Software, Inc. disclaims all warranties, including merchantability and fitness for a particular purpose. 15. Limitation of Liability To the fullest extent allowed by law, Gammal Software, Inc. will not be liable for indirect, incidental, special, or consequential damages, or loss of profits, data, or goodwill. In no event shall Gammal Software's total aggregate liability exceed the amounts paid by you to Gammal Software in the twelve (12) months preceding the claim. 16. Governing Law & Venue This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes will be resolved exclusively in the courts located in Ontario, Canada. 17. Force Majeure Gammal Software, Inc. isn't liable for failure due to causes beyond its control (acts of God, war, strikes, etc.). 18. Assignment & Delegation You may not assign this Agreement without Gammal's consent. Gammal may assign to an affiliate. 19. Audit Rights Gammal may audit your compliance with license terms upon reasonable notice. 20. Waiver & Severability Failure to enforce a right isn't waiver of future enforcement. If a provision is unenforceable, the remainder remains in effect. 21. Source Code Escrow Reserved. 22. Entire Agreement This EULA and applicable third-party licenses constitute the entire agreement and supersede prior agreements. 23. Feedback License Any feedback you provide is non-confidential and Gammal may use it without obligation. 24. Browser Automation & Web Scraping MetaDock provides browser automation features including programmatic navigation, element interaction, JavaScript execution, and data extraction. These features are provided for legitimate purposes such as software testing, authorized research, productivity enhancement, and personal automation. YOU ARE SOLELY RESPONSIBLE FOR ENSURING YOUR USE OF AUTOMATION FEATURES COMPLIES WITH: (a) All applicable laws, including but not limited to the Computer Fraud and Abuse Act (CFAA), the Canadian Criminal Code provisions on unauthorized computer access, and equivalent laws in your jurisdiction. (b) The Terms of Service of any websites or online services you interact with using MetaDock. (c) All applicable data protection and privacy laws when collecting or processing any data. Gammal Software, Inc. is not responsible for any consequences arising from your use of automation features, including but not limited to legal action, account suspensions, access restrictions, or civil or criminal liability. 25. AI-Assisted Automation MetaDock includes AI assistant features that integrate with cloud-based AI providers (including, without limitation, OpenAI, Anthropic, Google Gemini, xAI Grok, Groq, Cerebras, and OpenRouter) and optionally with locally-run models (Ollama). The assistant can converse with you, process attached images and files, and execute actions inside MetaDock including controlling browsers, navigating pages, executing scripts, managing workspaces, and otherwise driving the application through Model Context Protocol (MCP) and related interfaces. When using AI features: (a) Third-Party AI Providers. MetaDock transmits your prompts, conversation history, attached images, and attached file content to whichever AI provider you select. Your messages leave your machine and are processed on that provider's servers under that provider's terms of service and privacy policy. You are solely responsible for reviewing and complying with each provider's terms, acceptable use policies, and privacy policies before sending any data through MetaDock. Do not transmit data that you are not authorized to share with the selected provider. (b) API Keys (Bring Your Own). When using cloud-based AI providers with your own API key, you are responsible for obtaining the key directly from the provider through legitimate means; keeping the key confidential; all usage, fees, charges, rate limits, and overages incurred under your key; and revoking compromised keys. Gammal Software does not have access to your API keys; they are stored locally on your machine. (c) Local Models (Ollama). When using Ollama or other local AI models, you are responsible for complying with the license terms of any model you download and run. Different models carry different licenses (commercial, research-only, open source). Gammal Software does not provide, host, or distribute AI models and does not warrant any model's fitness for a particular purpose. (d) AI-Generated Content. Content generated by AI models may contain errors, inaccuracies, or hallucinations and may be subject to the AI provider's content policies and restrictions. AI output should not be relied upon for medical, legal, financial, or other professional advice. You remain responsible for verifying and validating any AI-generated content before relying on, distributing, or acting on it. (e) Browser and Workspace Control. When the AI assistant executes actions inside MetaDock, it acts using your real, logged-in browser profiles and has access to whatever those profiles can access (cookies, saved sessions, accounts, payment methods, attached proxies, and bookmarked services). You acknowledge that the AI may take actions you did not explicitly request; that you should monitor AI-driven operations, especially for sensitive accounts or destructive actions; and that you remain solely responsible for all actions performed by AI assistants through MetaDock, regardless of whether you directly initiated each action, and for ensuring those actions comply with all applicable laws, website terms of service, and this Agreement. (f) No Endorsement. Gammal Software does not endorse, partner with, or have any affiliation with the AI providers available through MetaDock unless explicitly stated. Integration is provided for user convenience. (g) Liability. Gammal Software is not responsible for: actions taken by AI assistants or their consequences; the accuracy or reliability of AI-generated content; costs incurred from AI API usage under your keys; data privacy practices of third-party AI providers; availability or performance of third-party AI services; or violations of any AI provider's terms of service. 26. API Usage MetaDock Pro includes access to local REST API, WebSocket, MCP (Model Context Protocol), CDP (Chrome DevTools Protocol), and Selenium WebDriver interfaces for programmatic control, together with headless mode and the mdk command line. These interfaces are not available on the MetaDock plan. The fourteen (14) day evaluation period described in §9.1.1 grants MetaDock Pro, so all of them are available during it. Where the interfaces are available, they are not metered: there is no monthly allowance and no daily cap. The API server runs locally on your own device, so throughput is bounded by your hardware rather than by an allowance. No limit in §9.1 differs between the two plans; automation is the whole of the difference. All API use is subject to the Fair Use Policy at https://metadock.app/fair-use API access is subject to: (a) API access is for your own personal or internal business use only. MetaDock licenses are for interactive use by a human operator. (b) You may not resell, sublicense, or provide API access as a service to third parties without written authorization from Gammal Software. (c) You may not use the API to build competing products or services. (d) API endpoints and functionality may change between versions without notice. (e) Gammal Software provides no uptime guarantees for local API services. Enterprise customers may negotiate SLA terms separately. (f) There is no API call limit and nothing is enforced per billing period. Access is governed by which plan you hold, not by volume: on MetaDock Pro the interfaces are unmetered, and on MetaDock they are not available at all. (g) Local Network Exposure. By default, the API surfaces bind to localhost only and are reachable only from the same machine. If you change this configuration to bind to a network interface reachable beyond your machine (LAN, VPN, or public internet), you alone are responsible for the security consequences, including any access by other devices on your network or by remote parties. Gammal Software is not responsible for unauthorized access, data exposure, account misuse, or any other consequence arising from a non-default bind configuration. (h) Authorized Connections and Third-Party Clients. Connections to the API surfaces (REST, WebSocket, CDP, WebDriver, and MCP) require your explicit approval through MetaDock's authorization prompt and a valid API key. Once approved, a connecting client (such as Puppeteer, Playwright, Selenium, Claude Desktop, Cursor, n8n, Make, or any other automation or AI tool) operates against your real, logged-in browser profiles and has access to whatever those profiles can access, including cookies, sessions, accounts, payment methods, and attached proxies. You are solely responsible for the conduct of any client you authorize, for periodically reviewing the Authorized Connections list, and for revoking any client that should no longer have access. Gammal Software is not responsible for any action taken by, or any consequence arising from, a client you have authorized. 27. Third-Party Platform Compliance MetaDock's profile isolation, User-Agent customization, and multi-browser capabilities are designed for legitimate use cases such as web development testing, managing separate personal and professional accounts on platforms that permit this, and privacy protection. Many online platforms prohibit operating multiple accounts, using automation, or misrepresenting your identity or device characteristics. You are solely responsible for understanding and complying with the terms of service of any platform you access through MetaDock. Gammal Software, Inc. disclaims all liability for account suspensions, bans, legal action, or other consequences resulting from your violation of third-party platform terms. 28. Proxy Usage MetaDock supports configuring HTTP/HTTPS/SOCKS proxy servers on a per-profile basis. When using proxy features: (a) You are solely responsible for ensuring your proxy usage complies with all applicable laws and the terms of service of both the proxy provider and any websites accessed through the proxy. (b) Gammal Software does not provide, endorse, or take responsibility for any third-party proxy services. (c) Using proxies to circumvent geographic restrictions, access controls, or evade bans may violate laws or terms of service. You assume all risk and liability for such usage. (d) Proxy connections may be less secure, slower, or less reliable than direct connections. Gammal Software is not responsible for any issues arising from proxy usage. 29. Device Emulation, Geolocation & Browser Fingerprint Customization 29.1 Availability Availability differs by surface, not by plan. The per-profile identity and geolocation controls in the desktop interface, and the advanced anti-fingerprinting persona system that adjusts, randomizes, or adds noise to the additional fingerprint signals listed below, are part of one feature set. That feature set is available on BOTH the MetaDock and MetaDock Pro plans. It is a property of the browser profile, not of the automation tier, so it is not fenced to Pro. It remains opt-in and subject to the acknowledgment in §29.3. Setting the User-Agent string, viewport, geolocation coordinates, and device emulation for a browser session PROGRAMMATICALLY, through the automation interfaces (REST, Model Context Protocol, Chrome DevTools Protocol, and W3C WebDriver) described in §25 and §26, requires MetaDock Pro, because those interfaces do. The same customizations remain available from the desktop interface on either plan. If the plans on which any of this is available change, the change will be announced at https://metadock.app and reflected in this EULA. 29.2 Signals That May Be Customized (both plans, except where noted) MetaDock's fingerprint customization operates on a per-profile basis and may include adjusting, randomizing, or adding noise to signals such as: * HTML5 Canvas, WebGL, AudioContext, and getBoundingClientRect / getClientRects readback * Reported GPU vendor, renderer, shading language version, supported extensions, and graphics capability limits * navigator properties including hardwareConcurrency, deviceMemory, screen dimensions, color depth, audio sample rate, and maxTouchPoints * navigator.userAgent, navigator.userAgentData, and Sec-CH-UA client hint headers * Accept-Language headers and the NetworkInformation API * WebRTC local IP candidate exposure (host candidate stripping and related modes) * Battery, plugins, speech synthesis voices, MediaCapabilities, and screen.orientation APIs * performance.now() and Date.now() resolution * navigator.permissions.query() result states * CSS user-preference media queries (prefers-color-scheme, prefers-reduced-motion, prefers-contrast, prefers-reduced-transparency) * Available font enumeration * Geolocation coordinates, timezone, and locale These features are intended for legitimate purposes such as web development and accessibility testing, defense against cross-site tracking and behavioral profiling by advertising and analytics networks, general privacy protection, and managing separate browsing contexts on platforms that permit this practice. (a) You are solely responsible for ensuring your use of device emulation, geolocation spoofing, and fingerprint customization complies with all applicable laws and the terms of service of any website, platform, or service you access. (b) Using these features to commit fraud, deceive others for unlawful gain, circumvent geographic restrictions, evade account suspensions or bans, manipulate advertising or analytics, defeat security or anti-abuse controls without authorization, or otherwise violate third-party terms of service is prohibited. (c) Some jurisdictions may have laws regarding misrepresentation of location, identity, or device characteristics, including in the context of regulated activities such as gambling, financial services, or restricted-content distribution. You are responsible for understanding and complying with such laws in your own jurisdiction and in any jurisdiction whose services you access. (d) Fingerprint customization is a best-effort technical measure. Gammal Software does not guarantee that any particular site, tracker, or detection system will or will not identify, link, or block your browser. Site operators may detect modified fingerprints and take action at their discretion, including blocking, account suspension, or other measures. (e) Gammal Software, Inc. is not responsible for any consequences arising from your use of these features, including but not limited to account suspensions, access restrictions, broken site functionality, legal action, or civil or criminal liability. 29.3 In-Product Acknowledgment Advanced fingerprint customization is off by default on every profile. Before it is enabled for the first time, MetaDock displays a notice describing what the feature changes and confirming that you remain responsible for complying with the terms of any service you use it with. The feature is not applied until you accept that notice. (a) The notice is shown once for the installation, not once per profile. Declining leaves the profile unchanged: the basic per-profile device emulation described in 29.1 continues to operate, and you may enable advanced customization later. (b) Accepting records the acknowledgment locally, on your own device. It is not transmitted to Gammal Software, Inc. (c) Acceptance applies to every profile on that installation, including profiles created afterwards. The responsibilities set out in 29.2 apply to each use of the feature regardless of when it was enabled, and regardless of whether it was enabled from the desktop interface, through the automation interfaces, or by importing a profile bundle in which it was already enabled. (d) The acknowledgment neither expands nor limits any term of this Agreement. It restates 29.2(a) at the point of use. 30. Privacy & Stealth Modes MetaDock includes privacy features (F8 Browser Privacy Mode) and full application stealth (F2 Full Interface Hide) with optional password protection. These features are provided for legitimate privacy purposes. (a) You are solely responsible for any use of stealth features. (b) Using stealth features to hide illegal activity, evade monitoring by employers or authorities with legitimate oversight, or circumvent security measures is prohibited. (c) Gammal Software is not responsible for any consequences arising from your use of privacy or stealth features. 31. Third-Party Applications (Beta Feature) MetaDock allows embedding third-party Windows applications within its workspace. This feature is currently in Beta. When you embed third-party applications: (a) You are responsible for ensuring you have the right to use those applications in this manner. (e) Beta features are provided AS-IS without warranty and may be unstable, cause crashes, or result in data loss. Gammal Software, Inc. is not responsible for any issues, data loss, or license violations arising from embedding third-party applications. 32. Web Browsing & Third-Party Content MetaDock includes web browsing functionality powered by Microsoft Edge WebView2. When browsing the web through MetaDock: (a) You may access third-party websites, services, and content that are not controlled by Gammal Software. (b) Gammal Software does not endorse, verify, or take responsibility for any third-party content, including its accuracy, legality, or safety. (c) Your interactions with third-party websites are governed by those websites' terms of service and privacy policies. (d) You are responsible for protecting yourself from malicious websites, phishing, malware, and other online threats. (e) Gammal Software is not responsible for any damages arising from your access to third-party content through MetaDock. 33. Browser Extensions MetaDock supports installation of Chromium-based browser extensions. When using browser extensions: (a) Extensions are provided by third parties and are subject to their own terms and privacy policies. (b) Gammal Software does not review, endorse, or warrant any extensions. (c) Extensions may have access to your browsing data, credentials, and other sensitive information. You install and use extensions at your own risk. (d) Malicious extensions may compromise your security or privacy. You are responsible for evaluating the safety of any extensions you install. (e) Gammal Software is not responsible for any issues arising from extension usage, including security breaches, data loss, or browser instability. 34. Financial Data Disclaimer MetaDock includes Symbol Manager functionality that opens third-party financial websites (TradingView, Yahoo Finance, FINVIZ, StockCharts, Investing.com, MarketWatch, etc.) for a ticker symbol you enter. MetaDock does not itself retrieve, generate, or validate any financial data; what you see is rendered by the provider's own website. (a) Financial data is provided by third parties for informational purposes only and should not be relied upon for investment decisions. (b) Gammal Software does not guarantee the accuracy, completeness, or timeliness of any financial data. (c) Financial data may be delayed, inaccurate, or unavailable. You should verify all information with authoritative sources before making any financial decisions. (d) MetaDock is not a financial advisor, broker, or investment service. Nothing in MetaDock constitutes financial advice. (e) Gammal Software is not responsible for any financial losses arising from reliance on data displayed in MetaDock. 35. Ad and Tracker Blocking MetaDock includes a built-in ad, tracker, and fingerprinting-script blocker that filters network requests against community-maintained filter lists (such as EasyList, EasyPrivacy, uBlock Origin filters, AdGuard lists, and others) and applies cosmetic rules to hide ad placeholders. You may enable, disable, or add filter lists, including custom filter list URLs of your choosing. When using ad and tracker blocking: (a) Third-Party Filter Lists. Filter lists, including those bundled with MetaDock, are produced and maintained by third parties. Gammal Software does not control, review, or warrant the contents of any filter list. Filter list maintainers may add, remove, or modify rules at any time without notice. (b) Custom Filter List URLs. If you add a custom filter list URL, you do so at your own risk. The URL is fetched and applied as provided by the source you specify; a malicious or misconfigured list may break sites you rely on or filter content in ways you do not expect. You are solely responsible for vetting any source you add. (c) Site Compatibility. Ad and tracker blocking may break payment flows, login pages, video players, or other site functionality on individual websites. You may disable blocking on a per-site basis. Gammal Software does not guarantee that any particular site will function correctly with blocking enabled. (d) Third-Party Site Terms. Some online services, including video platforms, news publishers, and ad-supported sites, prohibit the use of ad blockers in their terms of service. By choosing to enable ad and tracker blocking on those services, you do so at your own risk and remain solely responsible for compliance with those services' terms. This includes, without limitation, the blocking of pre-roll, mid-roll, end-roll, or in-page ads on video and streaming platforms. (e) No Warranty. Ad and tracker blocking is provided AS-IS as a best-effort technical measure. Gammal Software does not guarantee that any particular ad, tracker, fingerprinter, or other unwanted content will or will not be blocked, and is not responsible for content that is or is not delivered to you through MetaDock as a result of these features. (f) Liability. Gammal Software is not responsible for any consequences arising from your use of, configuration of, or reliance on ad and tracker blocking, including site breakage, account suspension or restriction by ad-supported services, legal action by content providers, or any third-party claim arising from blocked or unblocked content. 36. Downloads & Captured Files MetaDock allows you to download files, save pages, and capture media from websites and other sources you visit. When using download or capture features: (a) Legality of Downloaded Content. You are solely responsible for ensuring that any file, document, image, audio, or video you download, save, or capture through MetaDock is something you have the legal right to obtain, store, and use, including in compliance with applicable copyright, trademark, privacy, and data-protection laws. (b) Source Site Terms. Some websites prohibit downloading, scraping, or capturing their content. You are solely responsible for understanding and complying with the terms of service of any site from which you obtain files through MetaDock. (c) Storage and Handling. MetaDock records downloaded files using the path chosen by Windows or your browser at the time of download. You are responsible for the contents of those files once on your device, including any obligation to scan for malware, to handle them in accordance with applicable laws, and to delete them when no longer needed. Removing an entry from the in-app download history does not delete the underlying file from disk. (d) Liability. Gammal Software is not responsible for: the legality of any file you obtain through MetaDock; any malware, copyright violation, or other consequence arising from downloaded content; loss or corruption of downloaded or partially-downloaded files (including transfers interrupted by application closure or system shutdown); or any third-party claim related to material you download or capture through the application. 37. Age Restriction MetaDock is intended for users 18 years of age or older. By using MetaDock, you represent that you are at least 18 years old. If you are under 18, you may not use MetaDock. 38. Health & Safety Warnings PHOTOSENSITIVE SEIZURE WARNING: A small percentage of people may experience seizures when exposed to certain visual elements, including flashing lights or patterns that may appear on computer screens. This may occur when using MetaDock, particularly when: - Multiple browser panels or applications update simultaneously - Viewing web content with animations or flashing elements - Rapidly switching between windows or workspaces - Auto-refresh features cause repeated page reloads If you or any family member has a history of seizures or epilepsy, consult a physician before using MetaDock. DISCONTINUE USE IMMEDIATELY and consult a physician if you experience any of the following symptoms: - Dizziness, altered vision, or eye twitching - Muscle twitching or involuntary movements - Loss of awareness, confusion, or disorientation - Convulsions or seizures TO REDUCE RISK OF PHOTOSENSITIVE SEIZURES: - Use MetaDock in a well-lit room - Take regular breaks (at least 15 minutes every hour) - Avoid prolonged use when tired - Reduce the number of simultaneously active/updating windows - Disable auto-refresh features if you are sensitive to screen flicker REPETITIVE STRAIN AND EYE STRAIN: Extended computer use may cause discomfort in hands, wrists, arms, shoulders, neck, or eyes. To reduce risk: - Take regular breaks and stretch - Maintain proper posture and ergonomic setup - Adjust screen brightness and use appropriate lighting - Consider using blue light filtering if using MetaDock for extended periods Gammal Software, Inc. is not responsible for any health issues arising from use of MetaDock. 39. Amendments to Terms Gammal Software, Inc. reserves the right to modify this Agreement at any time. Material changes will be communicated via: - Email to your registered address (if available) - In-app notification upon next login - Notice on our website at https://metadock.app Changes take effect 30 days after notification unless otherwise specified. Continued use of MetaDock after changes take effect constitutes acceptance of the modified terms. If you do not agree to the modified terms, you must stop using MetaDock and cancel your subscription. For paying subscribers resident in Quebec or Ontario, during the 30-day advance-notice period you may terminate your subscription without penalty by emailing support@metadock.app or by cancelling through the Stripe billing portal link in your purchase or license-recovery email, and you will receive a pro-rated refund of any pre-paid period that follows the effective date of the change. This implements the consumer-protection requirements of Quebec Consumer Protection Act s. 11.2 and Ontario Consumer Protection Act, 2002 ss. 42 and 73. 40. Service Availability (a) MetaDock is provided on an "as available" basis. Gammal Software does not guarantee uninterrupted or error-free operation. (b) License validation servers may experience downtime for maintenance, updates, or unforeseen issues. During such times, license validation may be temporarily unavailable. (c) Gammal Software reserves the right to discontinue MetaDock or any features at any time with 90 days notice to active subscribers. Data Controller & Contact Gammal Software, Inc. (Ontario, Canada) is the data controller and is subject to the Personal Information Protection and Electronic Documents Act (PIPEDA) as well as applicable provincial privacy legislation. Privacy Officer: privacy@metadock.app GDPR inquiries: privacy@metadock.app 2. Data We Process MetaDock stores all workspace data, browser profiles, bookmarks, and settings locally on your device. Gammal Software has no access to your local data. When you request a free-tier key, subscribe, or contact us, we collect the email address needed to deliver the service and respond to you. MetaDock is license-key based and does not require a website account or password. The trial request form also asks what you do, what industry you are in, and what you will mainly use MetaDock for, as a category and in your own words. Those four answers are required to submit the form. It also asks how many people work with you, where you heard about us, what you use today and where you work; those four are optional. All of it is used only to understand who MetaDock is for and what it is compared against. None of it decides anything about you or your trial, is shared with advertisers, or adds you to marketing email. When you subscribe to a Gammal Software mailing list, we also record the IP address, browser user agent, and referring page of the signup, which we keep as proof of consent under Canada's Anti-Spam Legislation. When you open an email we send, we record that open event together with the IP address and user agent that requested the tracking image. Licence activation and validation are a separate, always-on flow. To issue and verify a licence we process your licence key, a hashed hardware identifier generated on your device, an installation identifier, an activation identifier, your edition, activation status, an optional machine nickname, and the time of the last successful validation. We rate-limit these requests by IP address and by identifier. This flow cannot be disabled while you hold an active licence, because it is what confirms your entitlement to use MetaDock. Third-party processors may handle: • Payment Data via Stripe (name, email, billing information for subscription processing). • Transactional and marketing email via Mailjet (email address and any optional name you provide). • Website analytics via Microsoft Clarity (session replays, click maps, scroll maps, and heatmaps on the metadock.app website ONLY, never inside the MetaDock desktop application). Microsoft Clarity is loaded only after you accept the analytics-cookie consent banner on the website. If you decline, no Clarity data is collected. • Website analytics via Google Analytics (aggregate traffic, page views and referral sources on the metadock.app website ONLY, never inside the MetaDock desktop application). IP addresses are anonymized, ad personalization and Google Signals are disabled, and page addresses are sent without query strings. Google Analytics is loaded only after you accept the analytics-cookie consent banner on the website. If you decline, no Google Analytics data is collected. • Affiliate referral attribution via Rewardful (which affiliate link you arrived on, and, if you complete a purchase, your billing email address so the sale can be credited to that affiliate) on the metadock.app website ONLY, never inside the MetaDock desktop application. Rewardful is loaded only after you accept the analytics-cookie consent banner AND only if you arrived through an affiliate link. If you decline, or if you did not arrive on such a link, no Rewardful data is collected. • Telemetry via Microsoft WebView2 (standard Edge performance diagnostics sent directly to Microsoft; MetaDock has no access to, or control over, WebView2 telemetry). • Crash diagnostics via Sentry (Functional Software, Inc., d/b/a Sentry). If MetaDock crashes, a crash report (stack traces, faulting module, OS and application version, your MetaDock edition, and the Qt version) is sent to Sentry for stability monitoring. No hardware identifier, installation identifier, licence key, or user record is attached to the report. File paths are sanitized to strip your username, and the breadcrumb, server-name, and user fields are removed before the report leaves your device. Crash reports are configured not to include browsing history, URLs, page content, search queries, passwords, cookies, or personal files, although a crash dump can incidentally capture fragments of application memory. Crash reporting honors the "Anonymous Usage Telemetry" setting (see below) and is processed on Sentry's servers in the United States. Usage Telemetry via Gammal Software: MetaDock periodically sends product-usage statistics to Gammal Software's servers. This telemetry is pseudonymous rather than anonymous: it carries a stable installation identifier that we are able to associate with the licence it was activated against. The data sent is: - A stable installation identifier generated on your device - Software edition and application version number - Operating system version and CPU architecture - Aggregate feature-usage counts, specifically the number of open browsers, mounted native applications, layouts, workspaces, and profiles: counts only, never the contents of profiles, browsing history, scripts, or user data - Application uptime in minutes - Your IP address, which our server uses to derive a country code. Only the country code is stored on the telemetry record. The IP address is not stored on that record, though our web servers log IP addresses separately as part of ordinary server operation. Crash diagnostics are a separate flow processed by Sentry; see "Third-party processors" above. The telemetry endpoint also accepts an activation token and a hashed hardware identifier for attribution where an installation identifier is not available. We use the resulting attribution to count active installations and to understand feature adoption by edition. We do not use it to build a behavioural profile of an individual user. This data does not include: browsing history, bookmarks, URLs visited, page content, search queries, passwords, cookies, or personal files. You can disable usage telemetry at any time in Settings > Privacy & Security > "Anonymous Usage Telemetry". The setting takes effect immediately. Data collected before you turn it off is not affected. The "Anonymous Usage Telemetry" toggle controls the optional product-improvement telemetry described above. It does NOT control: - License-verification probes required to confirm your subscription is active. These are necessary for the service to function and cannot be disabled while you hold an active license (legal basis: contract performance under PIPEDA and GDPR Art. 6(1)(b)). - Microsoft WebView2 diagnostics sent directly to Microsoft. These are controlled by Microsoft's WebView2 settings, not by MetaDock. 3. Legal Bases PIPEDA (Canada): • Consent: Implied consent for routine business processing; express consent for sensitive information. • Accountability: Gammal Software is responsible for personal information under its control, including data handled by third-party processors. GDPR (EU/UK): • Contract performance (subscription billing). • Legitimate interests (software improvement). 4. Use of Data • Billing & renewals (Stripe). • Product diagnostics & improvements (Microsoft). • Application stability monitoring and crash diagnostics (Sentry). • Understanding active user counts, popular features, and platform distribution to guide development priorities (Gammal Software usage telemetry). 5. Data Retention • Stripe: up to 7 years per financial regulations. • Mailjet: until you unsubscribe from marketing messages or your subscription records are deleted. Marketing list opt-outs are honored within ten (10) business days, the maximum permitted under Canada's Anti-Spam Legislation (CASL) s. 11(3). • Microsoft Clarity: up to 1 year (session replay cookies expire after 1 year; aggregated data is retained per Microsoft's privacy policy). • Google Analytics: up to 2 years (the _ga cookie expires after 2 years; aggregated reporting data is retained per Google's privacy policy). • Rewardful: referral cookie expires after 60 days; referral and commission records are retained per Rewardful's privacy policy. • Microsoft WebView2 Telemetry: up to 90 days, controlled by Microsoft. • Sentry (crash diagnostics): up to 90 days, then deleted. • Gammal Software Usage Telemetry: retained for as long as we operate the product. We are implementing a 12-month limit after which individual telemetry records are aggregated into summary statistics and the individual records are deleted. Until that is in production we do not represent that individual records are deleted on a fixed schedule. You may request deletion of telemetry associated with your licence at any time by emailing privacy@metadock.app. • Mailing-list subscriber records (email address, optional name, signup IP address, user agent, referrer, and email open events): retained until you unsubscribe or ask us to delete them. 6. Security Measures Processors implement TLS, AES-256 encryption, access controls, and vulnerability assessments. 7. International Transfers Data may transfer outside Canada under Standard Contractual Clauses. 8. Cookies & Tracking MetaDock's embedded browser may store cookies for web content you visit through it; these cookies belong to those websites and are managed per-profile, stored locally on your device. The metadock.app website uses one consent-gated cookie category: • Analytics and affiliate cookies (Microsoft Clarity, Google Analytics, Rewardful): set only after you accept the analytics-cookie consent banner, and the Rewardful cookie additionally only if you arrived through an affiliate link. You may withdraw consent at any time by clicking "Cookie Preferences" in the metadock.app footer. No tracking cookies of any kind are set inside the MetaDock desktop application. 9. Children's Privacy Not directed to under-18s. We don't knowingly collect from minors. Contact privacy@metadock.app for concerns. 10. User Rights PIPEDA (Canada): You have the right to access your personal information held by Gammal Software, request correction of inaccurate data, and withdraw consent (subject to legal or contractual restrictions). Complaints may be filed with the Office of the Privacy Commissioner of Canada (OPC). Quebec Law 25: If you reside in Quebec, you have additional rights under An Act to modernize legislative provisions as regards the protection of personal information ("Law 25"), including: • Right to information at the time of collection (purposes, recipients, retention period, your rights of access and rectification). • Right to data portability (effective September 2024): receive your data in a structured, commonly-used technological format. • Right to de-indexation where dissemination of your personal information causes serious injury and is not justified by law. • Right to be informed of any automated decision-making (we do not currently use automated decision-making or profiling). • Right to lodge a complaint with the Commission d'accès à l'information du Québec (CAI): https://www.cai.gouv.qc.ca, 1-888-528-7741.
